Massachusetts Seeks to Overhaul Alimony System Both Houses of the Massachusetts Legislature recently passed new legislation which would significantly overhaul alimony issued by Massachusetts courts. The bill now awaits the signature of Governor Duval Patrick. Under the legislation, the courts would be limited in issuing alimony orders depending on the length of the marriage. By way of example, if a marriage is five years or less, alimony would be no more than one-half the length of the marriage. Similarly, in marriage of between six and ten years, alimony would last no more than 60% of the length of the marriage. More importantly, for a person who is ordered to pay alimony under an order issued prior to the passing of the legislation, the legislation allows them to petition the court to reexamine the order under the new law.
