Do Engagement Rings Need To Be Returned?

On Behalf of | Mar 18, 2014 | Divorce & Family

Typically, a gift need not be returned when given to a friend or loved one. An exception to the rule of law is when the gift is given conditionally. When a gift comes with a condition, the item or property may need to be returned if the condition is not satisfied. Engagement rings may fall under this latter category. As such, the person who gives an engagement ring may seek the return of the engagement ring when the engagement is terminated by his or her fiancé. Accordingly, if the recipient of the engagement ring has an affair or cheats on his or her fiancé, the engagement ring may need to be returned.

If you have any questions regarding the return of an engagement ring, please contact an attorney at Hamblett & Kerrigan.
